By accessing or using Carza ("the Service"), operated by ZWD Creative LLC dba Carza ("we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.
Carza is a platform that allows car enthusiasts, DIY-ers, and gearheads to document project cars, showcase vehicles, and buy, sell, or exchange automotive parts with other users.

You retain ownership of any content you post, upload, or share on the Service ("User Content"). By posting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, distribute, and display your User Content in connection with operating and promoting the Service.
You represent and warrant that your User Content does not violate any third-party rights, including intellectual property rights, privacy rights, or publicity rights.

Content Moderation: We reserve the right to review, modify, or remove any User Content at our sole discretion. We may remove content that violates these Terms or is otherwise objectionable. Repeated violations may result in warnings, temporary suspension, or permanent termination of your account.
Carza operates as a marketplace platform that facilitates transactions between buyers and sellers of automotive parts. We are not a party to the actual sale transaction between buyers and sellers.
Transaction Fees: Carza charges a transaction fee on each completed sale. This fee is calculated as a percentage of the sale price and is added to the total amount paid by the buyer. The current transaction fee percentage is displayed at checkout. Transaction fees are non-refundable except as required by law.
Payment Processing: Payments are processed through third-party payment processors (currently Stripe). By using the Service, you agree to comply with the payment processor's terms of service. Carza is not responsible for the actions or policies of third-party payment processors.
Refunds and Returns: Refund and return policies are determined by individual sellers. Buyers should review seller policies before completing a purchase. Carza may facilitate refund requests but is not responsible for seller refund decisions. If a refund is issued, transaction fees are non-refundable unless required by applicable law.
Dispute Resolution: In the event of a dispute between buyer and seller, Carza may, at its discretion, attempt to facilitate resolution. However, Carza is not obligated to resolve disputes and does not guarantee any particular outcome. Users are encouraged to communicate directly to resolve issues. Carza reserves the right to suspend or terminate accounts involved in fraudulent or abusive behavior.
Liability: Carza acts solely as a marketplace facilitator and is not responsible for the quality, safety, legality, or accuracy of parts listed by sellers. Buyers purchase parts at their own risk. Carza does not guarantee that parts will be compatible with specific vehicles or that sellers will fulfill their obligations.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
Part Compatibility and Vehicle Modifications: Carza does not warrant or guarantee that any parts listed on the Service will be compatible with your specific vehicle, make, model, or year. Vehicle compatibility information is provided by sellers and may be inaccurate or incomplete. It is your responsibility to verify part compatibility before purchasing. Carza is not responsible for any damage, injury, or loss resulting from the installation or use of parts purchased through the Service.
Vehicle Modifications: Modifying vehicles may affect safety, emissions, warranty coverage, and legal compliance. Carza is not responsible for any consequences resulting from vehicle modifications using parts purchased through the Service. Users are solely responsible for ensuring modifications comply with applicable laws and regulations.
Safety Disclaimer: Automotive parts, especially used or aftermarket parts, may have wear, defects, or compatibility issues that could affect vehicle safety. Always have parts inspected by a qualified mechanic before installation. Carza is not responsible for any accidents, injuries, or damage resulting from the use of parts purchased through the Service.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ZWD CREATIVE LLC DBA CARZA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE USE OF OR INABILITY TO USE THE SERVICE EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRIOR TO THE EVENT GIVING RISE TO THE LIABILITY, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.
Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability for incidental or consequential damages, so the above limitations may not apply to you.

We may terminate or suspend your account and access to the Service immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

Binding Arbitration: If we cannot resolve a dispute informally, you and Carza agree to resolve any claims relating to these Terms or the Service through final and binding arbitration, except as set forth below. The arbitration will be conducted by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. The arbitration will take place in Delaware, unless you and we agree otherwise.
Exceptions: You may opt out of this arbitration agreement by sending written notice within 30 days of first accepting these Terms. Either party may bring a lawsuit in small claims court or for injunctive relief to stop unauthorized use or abuse of the Service.
Class Action Waiver: You agree that disputes will be resolved individually and that you will not bring a claim as a plaintiff or class member in a class, consolidated, or representative action.
